1. Agreement to Terms

By accessing or using the services of NextUP Enterprise ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

These Terms apply to all visitors, clients, and others who access or use our website at nextupenterprise.com and our credit repair services.

2. Description of Services

NextUP Enterprise provides credit repair consultation and dispute services, including:

• Review and analysis of your credit reports from all three major bureaus
• Preparation and submission of dispute letters on your behalf
• Credit building guidance and strategy
• Access to a client portal for tracking dispute progress
• Real human support throughout the process

We operate in compliance with the Credit Repair Organizations Act (CROA), 15 U.S.C. §1679 et seq.

3. CROA Disclosures

As required by the Credit Repair Organizations Act, you are hereby notified:

• You have the right to dispute inaccurate information in your credit report yourself, without cost, by contacting the credit bureaus directly
• You have the right to cancel your contract with us within 3 business days of signing without penalty or obligation
• We cannot promise or guarantee any specific results, including removal of accurate, current, and verifiable information from your credit report
• We will provide you with a written contract detailing our services before any work begins

4. No Upfront Fees

In compliance with CROA, NextUP Enterprise does not charge fees before services have been fully performed for that billing period. Monthly clients are billed after each completed service cycle. All billing terms will be clearly stated in your service agreement.

5. No Guarantee of Results

Credit repair results vary by individual. We cannot guarantee the removal of any specific item from your credit report. We dispute items that are inaccurate, unverifiable, or outdated under the Fair Credit Reporting Act (FCRA). Accurate and verifiable negative information may not be removable.

Any company that guarantees specific credit repair results is making representations that may violate federal law.

6. Client Responsibilities

To receive services, you agree to:

• Provide accurate and truthful information about yourself and your credit situation
• Enroll in a credit monitoring service (such as SmartCredit) and provide access so we can review your reports
• Respond promptly to requests for documentation or information
• Notify us of any changes to your contact information
• Not submit dispute letters independently on items we are actively disputing without notifying us

7. Payment Terms

• Month-to-Month Plan ($125/mo): Billed monthly after each service cycle. Cards are never stored. You will receive a separate invoice each month you choose to continue.
• Credit Builder Plan ($597): One-time payment covering 6 full months of service.
• All payments are processed securely through Stripe.
• Refunds are handled on a case-by-case basis. Contact us within 3 business days of payment if you wish to cancel.

8. Cancellation

Month-to-month clients may cancel at any time with no penalty by emailing support@nextupenterprise.com or calling 570-203-1530. Cancellation takes effect at the end of the current billing period.

Under CROA, you may cancel any new contract within 3 business days of signing for a full refund.

9. Prohibited Uses

You agree not to use our services to:

• Provide false or misleading information to credit bureaus or creditors
• Create a new credit identity (synthetic identity fraud)
• Engage in any activity that violates federal or state law
• Reproduce, duplicate, or resell any part of our service without permission

10. Intellectual Property

All content on nextupenterprise.com — including text, graphics, logos, dispute templates, and guides — is the property of NextUP Enterprise and protected by copyright law. You may not reproduce or distribute our materials without written permission.

11. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not warrant that our services will meet your specific requirements or that results will be achieved within any particular timeframe. Credit outcomes depend on factors outside our control, including creditor responses and bureau processing times.

12. Limitation of Liability

To the maximum extent permitted by law, NextUP Enterprise shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 30 days prior to the claim.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of Luzerne County, Pennsylvania, or through binding arbitration as mutually agreed.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a revised date. Your continued use of our services after changes constitutes acceptance of the new Terms.
